All Achievers Vortex Members are subject to these ‘Terms and Conditions’ and ‘Privacy Policy’.
All paying private-training members who have purchased either a recurring and/or a one-time private training plan are subject to the Terms and Conditions found here.

Overview
Thank you for choosing Achievers Vortex, an online soccer training platform owned and operated by AQR Training. These Terms and Conditions ("Terms") govern your use of the Achievers Vortex platform, including all content, features, and services offered through the platform (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.

Eligibility

  1. To use the Platform, you must be at least 10 years old and have the legal capacity to enter into a contract. If you are under 18 years old, you must have your parent or legal guardian's permission to use the Platform.

Registration and Account

  1. To access certain features of the Platform, you may need to create an account. You agree to provide accurate and complete information when creating your account and to update your information promptly to keep it accurate. You are responsible for keeping your account password confidential and secure. You agree not to share your password with others. You are responsible for all activity that occurs on your account, whether or not you authorized it.

Content

  1. AQR Training owns and operates the Platform and all content contained therein, including but not limited to videos, text, images, and graphics (collectively, the "Content"). The Content is protected by copyright and other intellectual property laws. You may not use the Content without the express written permission of AQR Training.

License and Membership

  1. Subject to your compliance with these Terms, AQR Training grants you a limited, non-exclusive, non-transferable, and revocable license, herein after refered to as the ‘Membership’ to access and use the Platform for your personal, non-commercial use only. You may not use the Platform for any other purpose without the express written permission of AQR Training.

  2. Achievers Vortex offers a paid Membership plan that provides access to all features of the Platform, including the Performance Lab, Perks, Achievers Hub, and AQR Assist. You can subscribe to a Membership plan by visiting the Platform's pricing page.

Payment and Billing

  1. You agree to provide AQR Training with accurate and complete payment information when you subscribe to the membership plan. AQR Training will charge your payment method on a recurring basis at the beginning of each billing cycle. You can cancel your membership at any time by following the instructions on the Platform. However, you will not be refunded for any unused portion of your membership fee.

Renewal

  1. Your membership will automatically renew at the end of each billing cycle unless you cancel your membership before the renewal date. You will be notified of your upcoming renewal date via email. You can review your renewal date and manage your membership settings by logging into your account on the Platform.

Changes to Membership Fees

  1. AQR Training reserves the right to change the membership fee at any time. If the membership fee is increased, you will be notified of the increase prior to the next billing cycle. You may cancel your membership before the effective date of the increase if you do not agree to the new fee.

Restrictions

You may not:

  1. Use the Platform for any illegal or unauthorized purpose.

  2. Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any Content without the express written permission of AQR Training.

  3. Decompile, reverse engineer, or disassemble any software used on the Platform.

  4. Use any robot, spider, or other automated device to access the Platform for any purpose.

  5. Interfere with or disrupt the Platform or servers or networks connected to the Platform.

  6. Violate any applicable laws or regulations.

  7. Violate any of the following amendments to “Restrictions” in § ‘Member Perks’ and § ‘AQR Assist Chatbot’.

Member Perks

  1. Achievers Vortex provides exclusive member benefits to paid subscribers, herein after referred to as, “Perks”. Perks may include discounts on products or services offered by third-party vendors. Member perks are solely accessible during the active billing cycle. Once a membership is terminated, members may still utilize their perks until the final active subscription date. Member perks are non-transferable, and sharing codes with others, regardless of their membership status, is strictly prohibited. If members are found to be sharing their perks, AQR Training reserves the right to revoke their membership and deny them further access to the Platform.

AQR Assist Chatbot

  1. AQR Assist is an AI-powered chatbot that offers members support and assistance on the Achievers Vortex Platform. AQR Assist can answer questions about the Platform, provide training tips, and connect members with other resources. Members are encouraged to use AQR Assist to get the most out of their Achievers Vortex experience.

  2. However, please note that AQR Assist is a tool, and it is not a replacement for human judgment or expertise. AQR Assist may not always be able to provide accurate or complete information, and it may sometimes provide incorrect or misleading information. Members should always use their own judgment when using AQR Assist, and they should not rely on AQR Assist for any critical decisions.

  3. AQR Assist is not a substitute for professional advice. If you have any questions about your health, fitness, or soccer skills, you should consult with a qualified professional.

  4. AQR Assist is a work in progress, and AQR Training is constantly improving its capabilities. Members should report any bugs or glitches that they encounter with AQR Assist to AQR Training so that they can be addressed.

AQR Assist Token Limits

AQR Assist is subject to certain token limits that are set by AQR Training. These limits are in place to ensure that the platform is fair, reliable for all users and to limit excessive costs.

Your current token limits for AQR Assist are as follows:

  1. Input limit: AQR Assist can take in a maximum of 4500 tokens. The input includes the chatbots back-end prompt, your chat’s history, and your messages.

  2. Output limit: AQR Assist can produce a maximum of 2500 tokens. The output includes the chatbots responses to your messages.

  3. Thread limit: AQR Assist can create up to 50 threads per day.

  4. Messages per thread limit: AQR Assist can send up to 100 messages per thread.

These limits are reset every 30 days.

If AQR Assist exceeds any of these limits, you may be temporarily suspended from the chatbot until the limits are reset.

Please note that these are just the current token limits. AQR Training may change these limits at any time.

Termination

  1. AQR Training may terminate your access to the Platform at any time for any reason, without notice. You may also terminate your account at any time by following the instructions on the Platform.

Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE". AQR Training MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AQR Training DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

IN NO EVENT SHALL AQR Training BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF AQR Training HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification

  1. You agree to indemnify and hold harmless AQR Training, its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

Governing Law

  1. These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts of the State of Texas in connection with any dispute arising out of or relating to these Terms.
